COMMISSION
MEETING December 10,
2001, 7:30 P. M., AT THE VIENNA
TOWNSHIP HALL, 3400 W. VIENNA ROAD, CLIO, MI 48420
PRESENT: Vernon Curtis, Lee Garner, Scott Preseau,
James Schweitzer, Ben Ranger, Gery
Giltinan, Robert Palmer, Beverley Williams, Mary Johnson.
ABSENT: Dale Frappier.
PREVIOUS MINUTES: November 26, 2001. Moved by Schweitzer, seconded by Preseau to
accept previous minutes as presented.
Motion carried.
NEW BUSINESS:
Item 1. Public hearing
for Sean Keenan, Zoning Manager for Nextel Corporation.
A. Mr. Keenan is
requesting a Special Land Use Permit to construct a new Wireless
Telecommunication Facility on property located at 4344 W. Frances
Road, Parcel
No. 18-33-300-013.
B.
Secretary Garner read publication notice to an audience of approximately
12
persons.
C.
Moved by Preseau, seconded by Giltinan to open public hearing.
Motion
carried.
D.
The proposal is for a 150-foot monopole tower.
E.
Jack Jump project Manager for W –5, a company employed by Nextel as a
consultant, was also present.
Mr. Jump spent 32 ½ years in the military as an
aviator. He explained his
credentials and stated that he feels very confident that
there is no conflict with the operation of Cagney Airport.
F.
Secretary Garner read a letter of opposition from Thomas Cagney, owner
of Cagney
Airport. His main concern was about the many
ultralight pilots who use this airport
and feels there is much danger to
them.
G.
When asked for his recommendation, Bob Palmer stated that, in his
opinion, this
proposed
tower is beyond the range of the tall building ordinance that the State
of Michigan wrote concerning the
impact on airports, it has been substantially
removed
from all properties, there are already several towers within a mile of the
area, therefore, he recommends
that this site should be approved.
H.
Meeting opened to the audience.
1. Thomas Cagney, owner of Cagney Airport spoke against the proposed
tower.
His main concern seemed to be for the ultralite pilots and
students
2. Raymond Pyrc, 9128 N. Linden Road, does not want this in his back
yard.
3. Cindy Paro, 9072 N. Linden Road, is concerned that her neighbors
at 9050 N.
Linden Road, Laura and Dan Stone, did not receive notice of the
meeting.
She is also concerned about the fall zone of the tower, about the
visibility from
her back yard, the possible environmental impact, real estate
values and does
not want this in her back yard.
Mr. Keenan explained that this tower is constructed to bend upon
itself and
would not affect the neighboring properties.
4. Tony McKerchie, 11167 West Glen, asked if the Township has
contacted
anyone else with expert knowledge, like another airport, to
see if this 1.4 mile is
adequate distance from the airport. Mr. McKerchie suggested that the Planning
Commission take a look at this.
5. Lyle Bellinger, owner of property at 9376 N. Linden Road, is
concerned about
property values and the tower being a health hazard.
Meeting closed to the audience.
I.
Discussion on distance from the expressway, approvals needed from FAA
and State
Aeronautics, and placing a light on the tower. Mr. Keenan stated he would put a
single beacon on the tower if the Planning Commission requires it.
Scott Preseau asked Mr. Cagney what he would consider a reasonable
distance
from the airport. Mr. Cagney answered that if it was 2 miles,
he wouldn’t be here.

After considerable discussion it was moved by Preseau and seconded by
Giltinan to
table action on this until January 14, 2002 to get more information.
Motion carried.
Item 2. Richard &
Janis Kelterborn, application for a Special Land Use Permit to increase their
Adult Foster Care License from 10 bed to 12 bed.
A.
Moved by Garner, seconded by Preseau to set a public hearing for Richard
& Janis
Kelterborn on January 14, 2002, with publication on January 2, 2002.
Motion carried.
Item 3. Sten Palmer,
Davison Land Surveying, requested Pre-preliminary Site Review for
Cedar Park Condominiums, to be located
between Pheasant Run and Ashtyn
Estates.
A.
Action on this was tabled at a meeting held on September 10, 2001,
pending
approval from the Genesee County Drain Commission on a storm water
plan. A
letter of approval, with certain
conditions, has been received from the Drain
Commission.
B.
When asked for his recommendation, Bob Palmer explained that this only
grants
approval
for them to go ahead with the
engineering. He, therefore, recommended
that the Planning Commission give
pre-preliminary approval.
C.
Moved by Ranger, seconded by Schweitzer to approve Pre-preliminary Site
Plan
for Davison Land Surveying.
Roll Call Vote: Yeas—Giltinan, Ranger, Preseau, Schweitzer,
Garner, Curtis.
Nays—None. Motion carried.
Item 4. Application
from Clio Fire Authority for a Special Land Use Permit to construct a new
Fire Station at 3400 W. Vienna
Road.
A.
The current C&M Building will be demolished, and they will have
space in back of
the new building. An easement has been given by Dennis &
Kathy Fuller to allow for
a front and rear entrance.
B.
The plan is for approximately 12,000 square feet with a training room,
weight room,
kitchen,
offices, and 5 double bays.
C.
Moved by Garner, seconded by Schweitzer to set public hearing on January
14,
2002,
with publication on January 2, 2002 for the Clio Fire Authority.
Motion carried.
Item 5. Moved by
Schweitzer, seconded by Garner to adjourn at 9:20 P. M.
