CHARTER TOWNSHIP OF VIENNA
  PLANNING COMMISSION MINUTES

Chairperson Curtis opened the meeting at 6:00pm, and led the Pledge of
Allegiance.
Present: Vernon Curtis, Gery Giltinan, Ben Ranger, Scott Preseau, Lee Garner, Dale Frappier
Bob Palmer, and Mary Johnson.
 
Absent: Max Schweitzer
 
Minutes: Motion by Garner, seconded by Preseau to approve the minutes of July 22, 2002
as presented. Voice vote, all ayes. Motion carries.
 
Additions/  
Changes: Bob Palmer reported that both pond issues under Unfinished Business will be
presented at the August 26, 2002 meeting.
 
Chairperson Curtis added a letter from the Railway to Unfinished Business, and also
the letter from McKenna & Associates.
 
Petitions: 1. Public Hearing for rezoning at Centennial Oaks, 3299 Pine St.
 
Gary & Maxine Howard, and Carl Carlson were present to present the project.
 
Chairperson Curtis opened discussion to the audience.
 
Bob Palmer said the the demo permit has been pulled for the greenhouses
and all commercial operations have now ceased. He said this was not an area for
C-2 zoning and recommends the rezoning be supported.
 
Pat Corcoran, 3350 Elmwood, asked if the zoning change does pass could they
put in anything they choose. Mr. Corcoran then presented a petition that opposes
opening Elmwood to thru traffic from the proposed site.
 
Don Lee, 11334 Sunset, not opposed to the rezoning, just does not want Elmwood
opened to traffic. Mr. Lee then asked the Board if all the signers on the petition could
be notified to the date of the upcoming site plan review.
 
Motion by Ranger, seconded by Giltinan to notify petitioners of the site plan hearing.
Voting yes: Preseau, Giltinan, Curtis, Garner, Ranger, Frappier.
Voting no: None, motion carries.
 
Chairperson Curtis opened comments to the Board.
 
Frappier said the rezoning will not stop the project.
Giltinan said that the Board could specify that Elmwood St. not be opened.
Palmer said we can only recommend to the County, as we are agents of the County
and they have final say.
 
Motion by Preseau, seconded by Ranger to recommend the rezoning to the
Township Board.
Voting yes: Ranger, Preseau, Curtis, Garner, Giltinan, Frappier
Voting no: None, motion carries.
2. Set Public Hearing for Dekalita Ent. Rezoning.
Secretary Garner read the Notice of Public Hearing with publish dates of August 7,
and August 14, 2002 with a hearing date of August 26, 2002.
Motion by Garner, seconded by Ranger to set Public Hearing for DeKalita rezoning
for August 26, 2002.
Voting yes: Preseau, Giltinan, Curtis, Garner, Ranger, Frappier.
Voting no: None, motion carries.
Unfinished  
Business: 1. Elizabeth's Assisted Living.
Chairperson Curtis explained that at the last meeting there was some question as
to what could go into the facility if the Merritt's ever sold. He then read a portion of
Act 218 of 1979, Item H which addresses this concern. He then opened for
comments from the audience.
Audrey Howell, 1385 W. Vienna Rd asked about plans for the extra parking and
placement of the dumpster.
Mr. Merritt said that he needs to keep parking relatively close to the front of the
building for the residents as well as family who come to see them, but he could put
parking in the back, leave some in the front. The dumpster will go in the back with
fencing around it.
Mr. Merritt will come back before the Board August 26, 2002 with plans showing
the parking areas and placement of the dumpster on the site plan.
Motion by Frappier, seconded by Giltinan to approve the Special Land Use for
Elizabeth's Assisted living to be classified a large group home for up to 20 residents.
Voting yes: Ranger, Preseau, Curtis, Garner, Frappier, Giltinan.
Voting no: None, motion carries.
Unfinished  
Business: 1. Letter from McKenna & Associates, Dave Nicholson concerning design review
requirements. Much discussion on whether the requirements should be an ordinance
or remain as guidelines. Whether the entire township would be covered or just the
BDA district.
It was decided to invite the BDA and the Township Board to a joint meeting on
September 5, 2002 at 6:00pm to discuss the draft of the new ordinances from
Vilican Leman.
2. Letter from the Michigan Railroads Association concerning setbacks along
railroad rights-of-way.
Motion by Ranger, seconded by Garner to table this issue until the August 26th
meeting. All ayes, motion carries.
The meeting was adjourned at 7:20pm.
