VIENNA TOWNSHIP PLANNING COMMISSION  
  SEPTEMBER 9, 2002  
 
Chairperson Curtis called the meeting to order at 6:00pm, and led the Pledge of  
Allegiance.  
Present: Vernon Curtis, Ben Ranger, Gery Giltinan, Scott Preseau, Max Schweitzer, Lee  
Garner, Bob Palmer, and Mary Johnson.  
 
Absent: Dale Frappier.  
Minutes: Motion by Schweitzer, seconded by Preseau to approve the minutes of 8-26-02 as  
presented. All ayes, motion carries.  
Motion by Preseau, seconded by Ranger to approve the minutes of 9-5-02 as  
presented. All ayes, motion carries.  
Additions/  
Changes: Add communications to # 8, Unfinished Business.  
Petitions: 1. Set Public Hearing for Little Caesar's Pizza Rezoning.  
Bob Palmer explained that Little Caesar's wanted to purchase property across from  
their present location in the Clio Mall and build a new store. Little Caesar's needs a  
new location but likes the area and wants to stay.  
Motion by Garner, seconded by Ranger to set a Public Hearing for Little Caesar's  
for September 23, 2002 with the publish dates of September 4th and 11th.  
Roll call vote. All ayes, motion carries.

Unfinished  
Business: 1. Gardner pond on Neff Rd.  
Nick Clark, 9205 Neff Rd. presented a copy of a "cease & desist" order from  
Genesee County Drain Commission dated July 23, 2001 to Mr. Gardner, and a copy  
of an undated agreement between Mr. Gardner and four other people agreeing to  
certain conditions of sand removal.  
Garner asked Mr. Gardner if he could give the Board a completion date for his pond.  
Mr. Gardner said no.  
Ranger said he has had the permit since May, 1989 and it still isn't complete.  
Audience Comments:  
1. Steve Heyink, 2101 Dodge Rd. asked if there were any monitoring  wells, aquafers,
and if the project had regular inspections. Mr Gardner said there were no wells.  
2. Randy Taylor asked if the Board will check into the "cease & desist" order.  
Chairperson Curtis said he would check tomorrow.  
3. Nick Clark, 9205 Neff Rd said he went to the site with the Jodi Stiles, GCDC  
and she said it was a mining operation not a pond.  
Mr. Garner said he will not put in a monitoring well, it's too expensive so he'll leave  
it as it is.  
It was decided the Pond Committee will meet with Mr Gardner at the site so he can  
show them what he has completed.  
James Cox, 9092 Neff Rd. asked about the landfill next to Gardner and was told  
that he should speak to the Building Inspector since it was not a Planning Comm.  
issue.  
Curtis said that Mr Gardner had been before this Board before and nothing gets done  
and asked for a completion date. He also asked how much dirt had to be removed.  
Palmer said that it was not a pond, it was a mining operation.  
Nick Clark said he takes sand out of the north end and uses large trucks, both are  
contrary to the signed agreement.  
Mr. Gardner said he does use larger trucks than the agreement states.  
2. Lammy pond on Frances Rd.  
Mr. Lammy said he has finished the east side of the pond, but needs more fill on the  
south side. The project is more than half completed and will be approcximately 15  
acres. The project is graded but not yet seeded.  
Curtis asked for a completion date. Mr Lammy said that by June 1, 2003 the east  
and south sides will be seeded and graded.  
Preseau asked that both gentlemen come back before the Board with a plan in the  
spring.  
Ranger said to Mr Gardner that he had been to the site and it was not a pond, it was  
a excavation site, and he needed a completion date.  
New Business: A joint meeting has been set for September 19, 2002 at 5:30pm with the Township  
Board and the BDA to continue the review of the new Master Plan.  
Meeting was adjourned at 7:15pm.
