CHARTER TOWNSHIP OF VIENNA
  PLANNING COMMISSION MINUTES
                             JANUARY 14, 2002
 
PRESENT: Vernon Curtis, James Schweitzer, Ben Ranger, Gery Giltinan, Lee
  Garner, Robert Palmer, and Mary Johnson.
 
ABSENT: Dale Frappier, and Scott Preseau.
 
MINUTES: Motion by Schweitzer, seconded by Garner to approve the minutes
  of December 10, 2001. All ayes. Motion carried.
 
ELECTION Motion by Schweitzer, seconded by Garner to appoint Curtis as
OF Chairman. All ayes. Motion carried.
OFFICERS  
  Motion by Curtis, seconded by Giltinan to appoint Ben Ranger
  as Vice-Chairman. All ayes. Motion carried.
 
  Motion by Schweitzer, seconded by Ranger to appoint Lee
  Garner as Secretary. All ayes. Motion carried.
 
NEW  
BUSINESS: 1. Continuation of Public Hearing for Sean Keenan, Nextel
      Communications.
 
  Mr. Keenan is requesting a Special Land Use Permit to
  construct a new Telecommunication Facility at 4344 W.
  Frances Rd. ID# 18-33-300-013.
   
  Chairman Curtis gave the audience a brief history of this request.
 
  Secretary Garner read a letter in opposition from Bernard & Ruth
  Bully, 4460 W. Frances Rd. to the audience of approximately 20.
 
  Gery Giltinan said he had visited both Frankenmuth and Dalton airports
  and both had cell towers and power lines with a height of 100-150'  within
  1/4 mile of their runways.
   
  Sean Keenan was asked if he had anything further to add. Mr. Keenan
  said that his application had followed the Townships ordinance exactly
  and explained that the map of the 80 acres was not split in two like it
  appeared on the map but is the 8th quarter section line. He said that if the
  Commission requested it he would add a light atop the tower.
 
  Chairman Curtis opened the meeting for public comment.
 
  1. Thomas Cagney, Cagney airport, said he thinks that cell towers  
      should be at least 3 miles from his airport. He also said the planes
      climb out over peoples houses inside the traffic pattern, and that
      ultralites fly 100' off the ground. He is afraid the tower will cause
      an accident.
 
  2. Greg Paro, 9072 N. Linden Rd. said that the tower will be almost
       in his backyard and he asked if any other sites had been considered.
     
  3. Helen Filpansick's daughter asked how many people in the audience
      has cell phones. She further said that the township police were switching
      to 2 way radios because reception was so bad. There is no danger to
      the community or any microwaves radiating from the tower.
     
  4. Cindy Paro, 9072 N. Linden Rd. asked for an explanation of co-locator.
      Mr. Keenan explained that the industry standard, and the preference of
      local governments were 4 companies to a tower, to cut down on the
      number of towers in an area. Ms. Paro then asked how many co-locator
      that the Board would allow.
     
  Chairman Curtis closed the meeting to the audience and asked for
  Board comments.
     
  1. Max Schweitzer said he would like to see a light atop the tower.  
     
  2. Lee Garner asked Mr. Keenan if he had asked Mr. Cagney what he  
      would consider to be a suitable distance from his airport. Mr. Keenan
      said he had not, but that he had met twice with Mr. Cagney to show him
      the plans, but he was unable to meet his demands and the Township's
      requirements.
     
  3. Vernon Curtis said that at the last meeting Mr. Cagney stated 2 miles
      from his airport was an acceptable distance for the tower and tonight he
      said 3 miles. Mr. Cagney said after he thought about it 3 was safer.
     
  4.  Gery Giltinan said that the man from Dalton airport that he spoke to said
       that the standard flight pattern distance was 1/2 mile from the runway.
   
  Motion by Schweitzer, seconded by Giltinan to approve the Nextel request
     
  Roll Call Vote:  Voting yes: Curtis, Schweitzer, Giltinan
                            Voting no:  Garner, Ranger. Motion carried.
     
  2. Public Hearing for Richard & Janis Kelterborn, Special Land Use
      Permit for Adult Foster Care.
     
      Richard or Janis Kelterborn were not present to present this request.
      Special Land Use request postponed until February 11, 2002. The
      Kelterborn's will be sent a letter informing them of this.
     
  3. Special Land Use permit to construct a new fire station at 3400 W.
      Vienna Rd. Clio Area Fire Authority.
     
      Presented by Tony McKerchie and Robert Palmer.  
     
      Mr. Palmer told the Board that the building will be 12,000 sq. ft. and will
      fit the needs of the department for the next 20-25 years, and it will be an
      attractive building and will benefit the community. They already have
      MDOT approval and hope to begin construction in the spring.
      Tony McKerchie said that the BDA had agreed to contribute $300,000
      over a period of 10 years. He also spoke about the easement from
      Dennis & Kathy Fuller on the east side of the site.
     
      Mr. Dolloff, 11500 Colonial Woods Dr. asked if the fire trucks had to go
      down Tacoma Ct. to return to the station, and was told that yes they do
      because of the turning radius on the truck.
     
      Kerry Paulson, 11520 Colonial Woods Dr. was present in support of the
      project.
     
     Chairman Curtis asked the Building Inspector for his recommendation.
     
     Mr. Palmer said there were some problems with the elevations and
     grades, but it can be worked out, he thinks it's the best place, and the
     
  Motion by Ranger, seconded by Garner to approve the Special Land Use
  to construct a new fire station.
     Voting yes: Curtis, Garner, Ranger, Schweitzer, Giltinan
     Voting no:   None.   Motion carried.
 
  Motion by Schweitzer, seconded by Curtis to adjourn at 8:45pm.
