CHARTER TOWNSHIP OF VIENNA
PLANNING COMMISSION MINUTES
JUNE 10, 2002, 6:00pm
Present: Vernon Curtis, Scott Preseau, Gery Giltinan, Dale Frappier, Lee Garner, Robert
Palmer, and Mary Johnson.
Absent: Max Schweitzer, Ben Ranger.
Also present: Vienna Township Board Members, and BDA Members. Dave Nicholson and 
Dave DeMarr.
Minutes: Motion by Frappier, seconded by Preseau to approve the minutes of May 13, 2002
as presented. All ayes. Motion carries.
Business: Dave DeMarr, Dutchman's Landing for final approval. 
Bob Palmer said they had a preconstruction meeting at the County this morning
and everything was ready to go, and the Board would have the paperwork soon. 
Motion by Curtis, seconded by Frappier to grant final approval with the stipulation
that the Board be given all the final approvals.
Voting yes: Preseau, Curtis, Giltinan, Frappier, and Garner.
Voting no: None.    Motion carries. 
Review of BDA Guidelines:
Chairperson Curtis introduced Dave Nicholson from McKenna & Associates. His
firm put together the BDA guidelines about a year ago.
Bob Palmer said the question is whether the guidelines should be made into an 
ordinance, which would then be the law, because the proposed ordinance could add   
a great deal of extra cost to any building. At present the Planning Commission
can only, suggest, not enforce. Perhaps a two tier plan would be better.
 
Dave Nicholson said the ordinance would assure higher quality development, which
was the intent of the BDA guidelines. A two tier plan could work, one in the BDA
district, and then one for the rest of the township, and this is a reasonable plan. 
The higher expectations in the BDA district makes sense because it will get higher
returns. Mr. Nicholson also said to be able enforce this plan it has to be an 
ordinance. The Planning Commission can strongly suggest, but can't enforce.
Tony McKerchie said that there is a lot of vacant land in the Township and we have to
plan for how we want to see it in 20 years. Maybe we will find that the rules are too
strict, and if that happens they can be amended. 
Mark Corba said he does not want to go against State code and get sued. 
Dick Scott said that the BDA was established to have control over development, and
that the BDA generates money to have a quality area. We do need an ordinance, but
must also have some flexibility built in it. 
Chairperson Curtis suggested that Mr. Nicholson be hired to bring back before this
Board examples of maybe three copies of regulations/ordinances from three
different communties to get an idea of what can be done. This group will meet again
in a month or so to review the information.
Kathy Ridley would also like examples of communities who have tried and failed
to enforce these ordinances. 
Mike Zinn reminded the Board to keep in mind the small businesses who have been
with us for years, and that we do not want to drive them out of business.
