CHARTER TOWNSHIP OF VIENNA
  PLANNING COMMISSION MINUTES
  DECEMBER 8, 2003
 
Chairperson Curtis opened the meeting at 6:00pm and led the Pledge of Allegiance.
 
Present: Vernon Curtis, Ben Ranger, Lee Garner, Doug Chilson, Dale Frappier, Max 
Schweitzer, Bob Palmer, and Mary Johnson.
 
Absent: Kathy Ridley, Gery Giltinan.
 
Minutes: Motion by Ranger, seconded by Frappier to approve the minutes of November 24, 03
as presented.  All ayes, motion carries.
 
Additions/ None.
Changes:  
 
Communications: A member of the audience handed out packets at the door titled " Why condos make 
good neighbors".
Aric Watts announced he had a petition if anyone wanted to sign it he would be in the
hallway.
 
Secretary Garner read the notice of public hearing.
Petitions: 1.   Howard Ent. 5171 Field Rd. Special Land Use. Carl Carlson of Flint Surveying
presented the project. He said the project is a duplex condo with 54 units in the first
phase. Bob Palmer explained the zoning is RSA and RA. The Future Land Use map
shows this type of development so this application is acceptable.
Chairperson Curtis opened comments to the audience.
1. Charles Calkins, 12447 Field Rd. said he knows change comes but this project
will change the community a lot. He is opposed to Field Rd. traffic.
2. Greg Cole, 12440 Field Rd. said he likes the slower pace, worried about traffic
with kids playing, elderly walking. He read a letter from his father, Roger Cole, who
does not support the project. He would like the only entrance off Vienna Rd.
3. George Taylor, 5156 Vienna Rd said he would like Vienna Rd to the Chargo land
rezoned to commercial from the front of the property to the first quarter mile deep.
4. James White, 12297 Field Rd. The construction will be noisy early to late at
night, doesn't want entry at the curve on Field Rd. Questioned if phase 2 was never built.
5. Eric Thomas, 9468 Webster asked if the Vienna Rd entrance will have a traffic light
and Bob Palmer said probably deceleration lanes but a light was up to MDOT.
6.James Dodd, 12309 Field Rd. said he will be forced to move if this goes forward.
7. Karen Mason, 12267 Field Rd. asked if construction traffic could go Vienna instead
of newly paved Field. Said the back northwest corner is low and there is a lot of water.
Mr. Carlson said he would give that consideration and that the detention pond will
take care of the problem.
8. Dennis Sanborn, 5211 Field Rd. said the construction traffic drives too fast now in
the Whispering Pines development. Doesn't think Field Rd.can handle more traffic.
Mr. Carlson said the construction traffic will be off Vienna not Field. Also that a
detention pond could be wet all the time but if it is a problem it can be changed.
9. Debbie Wilkes, 11187 Webster Rd. asked if the developer has secured parcels
B & C, and the realtor, Mike Davidson said the owner is keeping B, and they have an
agreement for the construction road on C.
10. Karen Nichols, 5206 Field Rd. is concerned about the speed on Field Rd. from
teenagers and the construction trucks. Water lays in the ditch now and will be worse.
11.Gary Cook, 5249 Field Rd. Would like construction traffic kept off Field.
Mr. Carlson said all construction traffic will be on Vienna Rd.
12. Aric Watts, 11427 Colonial Woods said the Board will vote yes anyway regardless
of what people want. Residents need to do a referendum to stop project. Said the Board
doesn't care about the homeowners. If the project is built you will have drug dealers,
he knows because he works for the Sheriff's Dept.
13. Steve Freheit, 12409 Field said he didn't want tan boxes, that he built a very
distinctive house and there was no thought or foresight put into this project.
Mr. Carlson said this will be a quality project.
14. Charles Calkins, 12447 Field Rd. asked about the process and Bob said tonight
is just "Permitted Use of Property" next is prepreliminary, and next preliminary.
15. Aric Watts, 11427 Colonial Woods said needing two roads was not true because
it's been done before when they wanted two but ended up with one.
Ben Ranger said the Board cannot consider the Vienna Rd. entrance because it does
not show on the plans.
Mr. Carlson said they have a commitment from the property owner to build the road.
16. Debbie Wilkes, 11187 Webster said if the owner gets a better offer for the property
it could be sold to someone else.
17. David Head, 5122 Field Rd said this project will detract from the neighborhood
which is a nice quiet area now.
18.Philip Pierson, 12430 Field Rd said he does not want anything on the property.
Chairperson Curtis closed comments to the audience and opened to the Board at 7:35.
1. Max Schweitzer said he would like the only entrance to be on Vienna Rd.
2. Ben Ranger asked if the Field Rd. entrance could be closed. He agrees with the
project to a certain extent if it could all be built at one time.
3.Doug Chilson said he is concerned with the front parcel, C, not being purchased,
because things could change in the future.
4. Lee Garner said he agreed with Ben about the entrance on Vienna Rd.only.
Motion by Ranger, seconded by Frappier to postpone this matter until December 22,
2003 for further review. Roll call vote. All ayes, motion carries. Chairperson Curtis
explained to the audience there would be no notification of this meeting, and called
for a five minute break.
 
2.    Harry Phillpotts Special Land Use, Vacant Land on Frances Rd. 18-32-300-013.
Secretary Garner read the Notice of Public Hearing.
Dave Rowe, Inland Seas, was present and explained the project. He said there is
a pond on the land and that would be preserved, and 12 lots will be sold. They are
talking with Mt. Morris Township about hooking to their sewer line. Bob Palmer said
this was a doable project but approval should be contingent upon the sewer agreement
with Mt. Morris.
Chairperson Curtis opened comments to the audience.
1. Eric Thomas, 9468 Webster Rd. asked when building was going to stop. When will
we have enough houses? He said people move here not to have neighbors.
2. Ross Thomas, 5318 W. Frances Rd. asked how much the houses will sell for, will
all the wells affect the current wells in the area?
 
3. Kenneth Brewer, 5402 Frances Rd. said he did not get a notification letter.
4. Gerald Totten, 5346 Frances Rd. asked if he would have to hook into the sewer,
and Bob said yes he would. State law says if it's available you have to hookup.
Mr. Totten also said he thought it was a good use of the land, and he supports the
project. Now it is used by some for target practice.
5. Ron Gruener, 5366 Frances Rd said vacant land is a safety issue. He said that BB's
have hit him and his barn before.
Chairperson Curtis closed comments to the audience and opened to the Board.
Max Schweitzer said the road will be wide enough to support the project.
Motion by Ranger, seconded by Garner to approve the Special Land Use subject to
an agreement with Mt. Morris Township allowing hookup to their sewers, and the waiver
for two homes on each side of the entrance to the project not being required to hook to
the sewer. Roll call vote. All ayes, motion carries.
3.  Kevin Marsee, Prepreliminary Site Plan Review.
Glen Vincil was present to present the project.
Bob Palmer explained that a notice of intent to call for a referendum has been
submitted to the Genesee County Clerk's office. Vienna Township's Attorney said
that the Board may go forward with the prepreliminary review tonight, and the ZBA
hearing in January.
Motion by Frappier, seconded by Garner to approve the Prepreliminary Site Plan.
Voting yes:  Schweitzer, Frappier, Garner, Chilson, Curtis
Voting no:  Ranger
Motion carries.
  1. Set Public Hearing for Sheila Lash, Special Land Use for December 22, 2003.
New Business: Motion by Garner, seconded by Ranger to set the public hearing for 12-22-03.
All ayes, motion carries.
