CHARTER TOWNSHIP OF VIENNA        
  PLANNING COMMISSION MINUTES  
  APRIL 26, 2004  
     
  Chairperson Curtis opened the meeting at 6:00pm.and led the Pledge of Allegiance.
 
Present: Vernon Curtis, Doug Chilson, Kathy Ridley, Gery Giltinan, John Krieger, Ben Ranger,
  Robert Palmer, and Mary Johnson.
 
Absent: Max Schweitzer.
 
Minutes: Motion by Ridley, seconded by Ranger to approve the minutes of 3-29-04 as
  presented. All ayes, motion carries.
Additions-
Chgs: None.
Comm: None.
 
Petitions: 1. Community Church of God Site Plan Review.
  Bud Worthing was present and spoke on the project. The addition will be 90 x 90.
 
  Chairperson Curtis opened comments to the audience.
  Sam Morgan, 12032 Schonborn Place said it will benefit the community.
 
  Bob Palmer said the site has sewer and water, access to the County drain and will
  much improve the look. He recommends approval.
 
  Motion by Ranger, seconded by Chilson to approve the site plan as presented.
  Roll call vote. All ayes, motion carries.
 
  2. Preliminary Site Plan for Liberty Springfield.
  Glenn Vincil was present and spoke on the project. Engineer Dave Rowe said they
  should have all their final approvals within two weeks.
 
  Chairperson Curtis opened comments to the audience. None.
  Chairperson Curtis opened comments to the Board.
  Some discussion on the pending lawsuit. The Board will request a written opinion
  from the Attorney on how to proceed before final approval.
 
  Motion by Giltinan, seconded by Ranger to approve the Preliminary Site Plan.
  Voting yes: Ridley, Giltinan, Chilson, Krieger, Curtis.
  Voting no:  Ranger.
  Motion carries.
 
  3. Rezoning of five parcels on N. Linden Rd. from RSA to C-2.
  Secretary Giltinan read the Notice of Public Hearing.
  Byron Voorheis spoke and said the three owners of the five parcels to be rezoned
  wanted to be consistant with the zoning on the other sides, to have contigious
  zoning in the area.
 
  Chairperson Curtis opened comments to the audience.
  Discussion on what type of businesses will be allowed in C-2 zoning, the referendum
  of a few years ago in the same area, and possible  impact on the school.
 
  Chairperson Curtis opened comments to the Board.
  Giltinan said he hoped everyone remembered all the public hearings the Board had
  while working on the Master Plan, and that the Board went to great lengths to do the
  best for everyone.
 
  Motion by Ranger, seconded by Chilson to recommend rezoning of parcel
  # 18-21-100-011. Roll call vote. All ayes, motion carries.
 
  Motion by Ranger, seconded by Chilson to recommend rezoning of parcel
  # 18-21-100-013. Roll call vote. All ayes, motion carries.
 
  Motion by Ranger, seconded by Chilson to recommend rezoning of parcel
  # 18-21-100-014. Roll call vote. All ayes, motion carries.
 
  Motion by Ranger, seconded by Chilson to recommend rezoning of parcel
  # 18-21-100-015. Roll call vote. All ayes, motion carries.
 
  Motion by Ridley, seconded by Krieger to recommend rezoning of parcel
  # 18-21-100-062.
  Voting yes: Krieger, Chilson, Giltinan, Curtis.
  Voting no:  Ridley, Ranger.
  Motion carries.
 
New Business: Set Public Hearing for Donald Morgan, Special Land Use.
  Motion by Giltinan, seconded by Ranger to set hearing for May 10, 2004.
  All ayes, motion carries.
 
  Set Public Hearing for Michael Davidson, Rezoning.
  Motion by Giltinan, seconded by Krieger to set hearing for May 10, 2004.
  All ayes, motion carries.
 
  Midge Dahle 3337 Field Rd. said there were two mistakes in the minutes of 2-23-04.
  She said # 3, under audience comments where it says " once a year they paid half
  of the mowing bill" it should have said "once a year they paid half of the mowing bill
  on the property to the east."
  She also said # 1, under audience comments by John Tucker  where he said
  the residents put in parking pads, it should have said the developer put in the pads.
  Mr. Tucker was not present.
 
  Meeting was adjourned at 8:30pm.
