  PLANNING COMMISSION MINUTES  
  FEBRUARY 23, 2004  
     
  Chairperson Curtis opened the meeting at 6:00pm.and led the Pledge of Allegiance.
 
Present: Vernon Curtis, Doug Chilson, Kathy Ridley, Gery Giltinan, Max Schweitzer, John
  Krieger,  Ben Ranger, Robert Palmer, and Mary Johnson.
 
Absent: None.
 
Minutes: Motion by Ridley, seconded by Schweitzer to postpone the minutes of 2-9-04 until
  the next meeting. All ayes, motion carries.

Petitions: 1. Dutchman's Development Prepreliminary Site Plan Review.
  David DeMarr was present and explained the project. He said this will be an upscale
  condo duplex project with 64 units. They will have three bedrooms and be 1311 sq ft.
 
  Bob Palmer said the site has sewer and water, access to the County drain, and is
  zoned RSA, so they will require a Special Land Use hearing. They will go to the ZBA
  before coming back for Preliminary Site Plan review.
 
  Chairperson Curtis opened comments to the audience. None.
  Chairperson Curtis opened comments to the Board. None.
 
  Motion by Ranger, seconded by Giltinan to approve the Prepreliminary Site Plan.
  All ayes, motion carries.
 
  2. Field Road Properties Prepreliminary Site Plan Review.
  Kevin Cook, Director of Engineering, CHMPS, was present and presented the
  project. They will need a Special Land Use hearing, and a ZBA hearing.
 
  Bob Palmer said this will be a true condo project, and it will be connected to the
  bike path.
 
  Chairperson Curtis opened comments to the audience.
 
  1. John Tucker, Attorney for the Mt. Vernon Condo Assc. said he had met with
  some of the residents and they had some concerns including boundary lines, the
  number of variances needed, and emergency vehicle access. He also said the
  residents had put parking pads and dumpsters on land owned by Field Road
  Properties and because they had maintained the property for a number of years
  there was now a question of who owned the property.
 
  2. Karen Mason, 12267 Field Rd. said adverse possession of the property wasn't
  valid because they had received money for maintenance
 
  3. Midge Dahle, 3337 Field Rd. said once a year they paid half of the mowing bill.
 
  4. David Pampalona, President of Field Road Properties, said there are boundary line
  issues to be resolved. He also said he met with the Building Inspector to determine
  what type of project the Township would like to see. They took great consideration
  with the plans.
 
  5. Dorothy Savageau, 3337 Field Rd. said Mt. Vernon residents paved the parking
  pads and were told they belonged to them.
 
  6. Christine Wright, 3337 Field Rd. said they had a meeting with the owner of the
  property about the parking pads and the dumpsters and he said he would try to
  preserve them, and she hopes it will work out.
 
  7. David Pampalona said tonight is just a conceptual process and he hopes the
  Board won't hold up the process because of the boundary dispute.
 
  Chairperson Curtis closed comments to the audience and opened to the Board.
 
  1. Ranger said he had no problem approving the prepreliminary because they will
  come back to the Board twice.
 
  2. Chilson said the Board shouldn't hold up the process for these issues. This is
  just a prepreliminary hearing.
 
  3. Giltinan said he is concerned about the number of variances they will need.
 
  4. Bob Palmer said that the current ordinances, written in 1987, does not address
  condos, so they will require variances, but under the new ordinances they will not.
 
  5. Ridley said she is concerned about emergency vehicles ingress and egress.
 
  6. Curtis said the boundary issues have to be worked out.
 
  Motion by Ranger, seconded by Chilson to approve the Prepreliminary Site Plan
  for Field Road Properties.
  Voting yes: Krieger, Ridley, Schweitzer, Ranger, Chilson, Curtis.
  Voting no:  Giltinan.
  Motion carries.
 
  Meeting was adjourned at 7:05pm.
