Minutes: Moved by Luttenbacher, seconded by Ridley to approve the August 1, 2005 minutes.
All in favor
Treasurer's Report: Luttenbacher presented the July 31, 2005 report.
Building Report: Palmer presented the July 2005 report.
Bills: Bill in the amount of $16,982.10 were presented.  Moved by Scott, seconded by Ridley to
approve the bills.

Nays - None Motion passed
Library Report: Zinn reported that the Clio Area Library is the 4th busiest library in the County.
Amphitheater Report: Scott stated that the Amphitheater is in bad shape financially.
Metropolitan Report: Luttenbacher stated that the long range plan until 2030 is in place and that the north end of
the county is not in the plan.
Fire Authority Report: Luttenbacher stated that the Fire Department is taking bids to repair the front of Station 2.
NEW BUSINESS:
1. Award bid for Fire Hall.  Moved by Scott, seconded by Luttenbacher to accept the proposal
from Siwek Construction in the amount of $1,959,000.00, with Alternate #1 being 
$64,000.00 and with the right to defer the decision on Alternate #2 in the amount of 
$18,000.00 for 30 days.

Nays - None Motion passed.
2. Water Connection Ordinance, No.368.  Moved by Luttenbacher, seconded by Zinn to
adopt the ordinance.
ROLL CALL: Yeas - Taylor, Zinn, McKerchie, Scott, Luttenbacher, Fuller, Ridley
Nays - None Motion passed
3. Rezoning Ordinance No. 369.  Vacant property Webster Rd., 12222 Webster Rd., vacant
property Vienna Rd., from RU1 (Residential Urban District) to RMC (Multiple Family
Condominium Residential District).  Moved by Fuller, seconded by Zinn to adopt the 
ordinance.
Public comment:
1. Herb Nelson, 1385 Vienna, stated that the development fits the master plan.  He would
also like this area to be developed under PUD.
2. Mike Laurin, 12244 Webster, is against the development and asked if the corporation is
trying to buy the surrounding properties.
3. Francis Corcoran, 4260 Farrand, has concerns about the water issue on his property, he's
wondering if it will back up onto his property.
4. Carl Ranger, 12241 Webster, would like the development to be single family homes and
is against the rezoning.
Clerk Scott stated that approximately 65 signatures were received opposing the rezoning.

4. Class C Liquor License, Lucky's Steak House, Resolution No. 08-15-05-80.  Moved by
Scott, seconded by Ridley to adopt the resolution that recommends that the State grant
Mr. Vasilakis a Liquor license that is good for one year from the date of this resolution.

5. Class C Liquor License, Applebee's, Resolution No. 08-15-05-81.  Moved by Luttenbacher,
seconded by Zinn to adopt the resolution.

Nays - None Motion passed
6. Vienna Towns Square, PUD.  Moved by Ridley, seconded by ( no one ) to postpone the
vote.  Motion died due to lack of support.  Moved by Luttenbacher, seconded by Zinn to:
Upon receipt of the report and recommendation of the Planning Commission, and after a
public hearing, the Board shall review all findings.  If the Board determines to grant the
application, it shall instruct the Township Attorney to prepare a contract setting forth the
conditions upon which such approval is based, which contract, after approval by resolution
of the Board, shall be executed by the Township and the applicant.  Approval shall be 
granted only upon the Board determining that all provisions of this ordinance have been met
 and that the proposed development will not adversely affect the public health, welfare and
safety.  The agreement shall be recorded with the Genesee County Register of Deeds.

7. Culvert replacement, Jennings Road.  Moved by Zinn, seconded by Luttenbacher that the
Township replaces the culverts and driveway easements that G. C. Road Commission tore
up during their ditching project.  The Township agrees to pay up to $10,000.00 for the
replacements.
