CHARTER TOWNSHIP OF VIENNA
   PLANNING COMMISSION MINUTES
  AUGUST 8, 2005
   
   
Chairperson Curtis opened the meeting at 6:00pm and led the Pledge of Allegiance.
Present: Vernon Curtis, Doug Chilson,  Ben Ranger, John Krieger, Gery Giltinan, Mike Zinn,
Bob Palmer, and Mary Johnson.
 
Absent: Max Schweitzer.
 
Communications  None.
 
Minutes: Motion by Ranger, seconded by Zinn to approve the minutes of 7-25-05 as presented.
All ayes. Motion carries.
 
New Business: Public Hearing for Vienna Town Square PUD.
Stephen Pawlaczyk, Atwell Hicks, presented a plan for a 400,000 sq. ft. retail
development. He said they will provide road improvements, a bike path, a 39' right of
way to widen the road, and a 15' watermain easement extension south to the school.
They will donate a parcel on Vienna Rd to the Township for a park, and will have
approximately 15% more landscaping than required.
 
Audience Comments: None
Board Comments: Ranger asked if any businesses have signed on for sure and was
told no, but that there have been many conversations.
Zinn asked if the intent was for the big outlots to own their land and was told yes,
but not the inline stores.
Curtis asked if the landscaping is the same as Wal-Marts and was told yes except
the north outlots, which are too small to have the islands.
He also asked about the location of the dumpsters, and said he didn't want to see
them from the road. Bob Palmer said they will all be enclosed, and a berm would
hide them. Curtis said he would like a fence on the south end by the tree line.
Giltinan asked if the building will be built as the contracts come and Mr. Dwyer said
yes, and that the size may vary alittle.
 
Motion by Curtis, seconded by Zinn that the proposed PUD meets or exceeds the
qualifications of Zoning Ordinance Section 2310 and adheres to the conditions for
qualification of the PUD option and promotes the land use goals and objectives of the
Township. Specifically:
1. District of RU-1 is consistant with PUD Ordinance, and the Master Plan allows
for Commercial use and medium density residential.
 
2. The proposed PUD is not used for the sole purpose of avoiding the applicable
zoning requirements, and shall result in an improvement to the public safety, health
and welfare. The PUD will accomplish objectives that cannot be accomplished thru
conventional zoning.
 
3. The proposed Pud will preserve open space, provide for cross access, the reduced
parking requirements will allow for larger green spaces, bike paths and sidewalks are
provided for, pedestrian traffic both within and the site and in relation to access
streets, building upgrades are in compliance with BDA standards. Traffic improvements
provided for, wetlands preservation and natural features preservation are provided for
in the PUD. 100 extra feet on Vienna Rd will be added to the existing wetlands to
make up for the wetlands in Parcel A.
 
4. The proposed PUD meets the following objectives: Permanently preserve open
space or natural features, permanently establish land use patterns which are
compatible to planned uses, set aside open space in perpetuity, guarantee provisions
of public improvement, promotes the goals and objectives of the Master Plan, and
fosters the aesthetic appearance of the Township through quality building.
 
5. The proposed PUD is not a substitute for a variance request or as a means to
increase density. The proposed PUD plan is deemed to comply with the applicable
provisions of Art. 23 and the Ordinance. Will add improvements to Linden Rd.
Furthermore as required in Section 2325.2b,2c, plans for disposing of sanitary
sewage, supplying the development with water, and the storm water drainage system
is adequate. The required road improvements specified in the PUD plan will be made
by the developer. With these findings I move that the Planning Commission recommend
that the Township Board approve the proposed PUD plan as presented.
 
Voting yes: Zinn, Ranger, Giltinan, Chilson, Krieger, Curtis.
Voting no:  None
Absent: Schweitzer.                    Motion carries.
 
Unfinished Bus: None.
 
New Business: Motion by Giltinan, seconded by Ranger to set a Public Hearing for Harry Phillpotts,
Special Land Use for a private road for August 22, 2005. All ayes, motion carries.
The meeting was adjourned at 6:55pm.
