VIENNA TOWNSHIP CLOSED SESSION									Proposed

Moved by Scott, seconded by Luttenbacher to go into closed session to review a letter from Attorney Doerr, subject to
Attorney / Client privilege.
Roll Call:	Yeas -	Belill, Scott, Luttenbacher, Fuller, Ridley
	Nays -	Taylor, Zinn						Motion passed
	The Building Inspector stated that there are over 1000 structures in existence in the Township which the assessing
department has determined were constructed without the Township Building Department issuing a building permit, conducting
an inspection, or approving the construction.  The Assessor is implementing a plan to add these structures to the assessment
rolls of the Township, as required by law.
	Attorney Doerr advises that:
	1.	That the construction code adopted by the Township requires that for certain non-exempt structures
		a building permit must be obtained prior to the commencement of construction.
	2.	That the construction code adopted by the Township also requires that the Building Inspection
		Department inspect the structure during construction and approve the structure for occupancy when
		a permit has been issued.
	3.	That for non-exempt structures for which a building permit was not issued, the Township must decide
		what action, if any, should be taken regarding the failure to obtain a building permit prior to
		commencement of construction.
	4.	That it also appears that the Township must evaluate the risk the Township takes by directing the
		Building Department to take no action regarding the failure to obtain a building permit prior to
		commencement of construction.
Moved by Ridley, seconded by Taylor to close the Closed Session at 6:48 p.m.
